Apartments vs Apartment in Kyrgyzstan - Legal Difference and Which Is Better to Buy

Listings for "apartments" (апартаменты) are appearing more and more frequently in Bishkek. Many buyers think it's just a fancy word for a regular flat. In fact, the difference is legal - and it matters.

What Apartments Are Legally

Apartments are premises in a building that is classified as non-residential (office, hotel, or mixed-use) under its documentation. Legally, this is not a flat but a non-residential space intended for temporary habitation.

Kyrgyzstan has no separate legal definition of "apartments" as in Russia, but in practice developers sell units in apart-hotels and mixed-use complexes under this name.

Why Apartments Are Cheaper than Flats

Apartments typically cost 15-30% less than comparable flats in the same area. Reasons:

For the developer: building a non-residential structure is simpler - fewer requirements for insolation, residential standards, and approvals.

For the buyer: it is a non-residential space, and different rules apply.

What You Cannot Do in Apartments

Permanent Registration

You cannot register permanently (propiska) in apartments - they are not residential premises. Only temporary registration is possible.

Consequences:

  • Clinic assignment by place of residence - through another address
  • Enrolling children in the local school - by registered address, not actual residence
  • Some government services require permanent registration

Mortgage - More Difficult

Most KR banks are reluctant to issue mortgages on apartments as non-residential premises. Some banks refuse outright. If they do offer a mortgage - conditions are worse (higher rate, larger down payment).

Social Infrastructure

An apartment developer is not required to provide residents with kindergartens or parking spaces at residential building standards.

When Apartments Make Sense

Investment for short-term rental: apartments in central Bishkek are a good option for daily rentals. The hotel status of the building simplifies running this type of business.

Office with residential option: for sole proprietors or small businesses.

Buyer with no intention to register: if you already have a residence with registration and are buying a "second address" or investment.

Foreign citizens: whose registration in KR is temporary anyway.

The Situation in Bishkek

In Bishkek, some complexes sell units as apartments but de facto market them as housing. Buyers don't always understand the difference. Before buying, always clarify:

  • What is the building's status in the project documentation (residential or non-residential)?
  • Is permanent registration possible?
  • Do banks accept this property as collateral for a mortgage?

Taxes on Apartments

The property tax for non-residential premises owned by individuals in KR differs from residential. Check current rates with the tax service.
