Real estate transactions by power of attorney are common in Kyrgyzstan. The property owner may be abroad, seriously ill, or simply unable to be present in person at the sale. In such cases they issue a power of attorney — a legal document allowing another person to act on their behalf.
However, transactions by power of attorney carry elevated risks for buyers. This article explains in full how to properly register a power of attorney, what to look out for, and how to protect yourself when buying an apartment from an authorised representative.
What a Real Estate Power of Attorney Is
A power of attorney is a written authorisation issued by one person (the principal) to another person (the agent) to represent them before third parties.
In real estate, a power of attorney allows the agent to:
- Sign the sale and purchase agreement
- Receive money from the buyer
- Submit documents for GRS registration
- Deregister the apartment
- Perform other legally significant actions
Legal basis — Civil Code of the Kyrgyz Republic, articles 185–189 (representation and power of attorney).
Types of Real Estate Powers of Attorney
1. General Power of Attorney
Grants the agent broad authority over all of the principal's property or a specific property. May include the right to sell, gift, exchange, lease, manage, etc.
Risk: Maximum. The agent receives virtually unlimited rights over the property.
When used: When the principal is going abroad for an extended period and wants the agent to fully manage their property.
2. Special Power of Attorney
Issued to perform a specific type of action with a specific property. For example: "to sell the apartment at 15 Moskovskaya St., Apt. 48, for no less than 5,000,000 som."
Risk: Moderate. Limited to specific actions.
Recommendation: The optimal option for selling a specific apartment.
3. Single-Use Power of Attorney
Issued to perform one specific action. For example: "to sign the sale and purchase agreement and submit documents for registration."
Risk: Minimal. After the action is performed, the power of attorney loses effect.
Requirements for Registering a Power of Attorney
A power of attorney for real estate transactions in Kyrgyzstan must be notarially certified.
Where it is registered:
- At any notary in Kyrgyzstan
- If the principal is abroad — at the KR consulate or embassy, or at a foreign notary with subsequent apostille
What is needed to register a power of attorney:
For the principal (owner):
- Passport (original)
- Title documents for the apartment
- Details of the agent (full name, passport details)
Cost of notarial certification:
- Notarial fee: from 1,000 to 3,000 som
- Legal and technical services: 1,000–2,000 som
- Total: from 2,000 to 5,000 som
Validity Period of a Power of Attorney
As a general rule, a power of attorney is valid for 3 years from the date of registration unless another term is specified.

Important: A power of attorney that does not state the date of execution is null and void (invalid by law).
When a Power of Attorney Automatically Ceases to Be Valid
This is a critically important section for real estate buyers. A power of attorney automatically ceases in the following cases:

Death of the principal — the most dangerous situation. If the principal has died and the agent continues to execute transactions under a "no longer valid" power of attorney, such transactions are void. The buyer loses both the money and the apartment (which passes to the heirs).

The principal is declared legally incapable or of limited capacity by a court

The principal revokes the power of attorney — at any time without giving reasons

How to Verify the Validity of a Power of Attorney
Before concluding a transaction with an agent, the buyer must satisfy themselves that the document is valid.
Verification methods:
1. Through the notary who certified the power of attorney Any notary can confirm by registry number whether the power of attorney has been revoked.
2. The Notarial Chamber of Kyrgyzstan The Notarial Chamber maintains a register of powers of attorney.
3. Direct contact with the principal Contact the owner directly — call or arrange a video call. Confirm:
- They are alive
- They genuinely issued the power of attorney
- They agree with the transaction terms (price, buyer)
- They have not revoked the power of attorney
4. Verifying the principal's details Make sure the details in the power of attorney match those in the title documents for the apartment.
Risks for Buyers in Transactions by Power of Attorney
Risk 1: Revocation of the Power of Attorney
The principal may revoke the power of attorney at any time. If this occurred after the agreement was signed but before GRS registration — the transaction may be declared invalid.
Protection: Confirm the validity of the power of attorney immediately before signing the agreement and on the day of GRS submission.
Risk 2: Death of the Principal
The most catastrophic scenario — the principal has died but the agent "sells" the apartment without disclosing this. The apartment already forms part of the estate, and heirs have the right to contest the transaction.
Protection: Insist on personal contact with the principal; refuse the transaction if a video call is impossible.
Risk 3: Fraud by the Agent
The agent may sell the apartment below market value and pocket the money without passing it to the principal.
For the buyer: Make sure the transaction terms match the principal's wishes.
Risk 4: Exceeding Authority
The agent performs actions not provided for in the power of attorney. For example, accepts money when this is not specified in the document.
Protection: Read the text of the power of attorney carefully. The authority must explicitly provide for all actions the agent will perform.
Risk 5: Forged Power of Attorney
Cases of forged powers of attorney have occurred in practice.
Protection: Always call the notary who certified the power of attorney. Verify the notary in the Notarial Chamber of KR register.
Safety Checklist When Buying an Apartment by Power of Attorney
Before signing the sale and purchase agreement, confirm:
- The power of attorney is notarially certified (not a simple written form)
- The power of attorney contains the date of issue
- The term of the power of attorney has not expired at the transaction date
- The power of attorney explicitly states the right to sell the specific property
- The power of attorney states the right to receive money (if the agent accepts payment)
- You called the certifying notary and confirmed it has not been revoked
- You spoke with the principal in person or by video call and confirmed their consent
- The principal is alive and legally capable
- The passport details in the power of attorney match those in the title documents
- There are no signs of document forgery
- You received a receipt for the money (if paying in cash)
