One of the most common questions when buying an apartment in Bishkek is: "What if the seller has outstanding utility debts — will I have to pay them?" Here is an honest breakdown.
Do Utility Debts Transfer to the New Owner?
Under the laws of the Kyrgyz Republic, utility debts are tied to the person, not to the apartment. This means that legally the debt remains with the former owner.
In practice, however, it is more complicated:
- Utility providers (Bishkekvodakanal, JSC Severelektro) often refuse to re-register the account until the outstanding balance is paid
- Management companies and homeowners' associations may demand payment of debts for building maintenance
- Gas debts (Gazprom Kyrgyzstan) can block reconnection for the new owner
So while you are not legally obliged to pay someone else's debts, in practice they will cause you significant inconvenience.
Which Debts Are Particularly Dangerous?
1. Gas Debts
The most problematic. Gazprom Kyrgyzstan may refuse to transfer the contract and suspend gas supply until the previous owner's debt is fully paid.
2. Electricity Debts
Severelektro (or Oshelektro, Vostokelektro depending on the area) also requires a debt-free certificate to re-register the meter.
3. Water and Sewerage Debts
Bishkekvodakanal may refuse to transfer the contract if there is an outstanding balance.
4. Management Company Debts
Technically not tied to the owner, but management companies often pressure the new resident to pay.
How to Check Utility Debts Before Buying
Ask the seller to provide certificates confirming no outstanding debts:
- Certificate from Severelektro — by the subscriber's personal account number
- Certificate from Bishkekvodakanal — by the property address
- Certificate from the management company — confirming no maintenance debts
- Certificate from Gazprom Kyrgyzstan — if the apartment has a gas supply
You can also check independently:
- Via the "Raschyotka" app (a payments aggregator in Kyrgyzstan)
- By visiting the relevant organisation's office with the property address
What to Include in the Purchase Agreement
Make sure to include a clause in the contract:
"The Seller guarantees the absence of debts on utility services, taxes and other mandatory payments. All debts arising before the date of signing this agreement remain the obligation of the Seller."
If there are debts, you can:
- Reduce the apartment price by the amount of the debt
- Cover the debts from the deposit or advance payment
- Require debts to be paid before notarisation
