When Is a Notary Mandatory Under KR Law?
Under the Civil Code of the Kyrgyz Republic, notarial certification is mandatory for:
- Gifting real estate to non-close relatives (and recommended even between close relatives)
- A will containing real property
- Annuity and lifetime maintenance contracts
- Transactions involving shares in joint ownership (sale of a share to a third party)
- A power of attorney to conduct real estate transactions
- A prenuptial agreement involving real estate

Why a Notary Is Still Needed Even for a Simple Sale
In practice, without a notary it is difficult to:
- Register the transfer of title at the State Registry (in practice they require a notarially certified contract or at minimum notarially certified signatures)
- Sell with a mortgage — banks require a notarial contract
- Conduct a transaction if the seller is married — a notarized spousal consent is required
- Formalize a deposit — without a notary, a deposit is poorly legally protected
Spousal Consent — The Most Critical Document
If the seller is married, a notarially certified spousal consent to the sale is required. Without it:
- The transaction may be contested in court within 1 year of the spouse learning about the sale
- The State Registry will refuse registration
Exception: if the apartment was received as a gift or through inheritance before the marriage — it is personal property and consent is not needed. But this must be proven with documents.
How Much Does a Notary Cost in Bishkek in 2026?
Notary fees are regulated by the Ministry of Justice of the KR. Approximate prices:

- Work with notaries specializing in real estate — they know all the nuances
- Do not use a notary persistently recommended by the other party — better to find a neutral one
- Clarify the full cost before visiting — fees for technical work may differ
What Does the Notary Check When Certifying a Transaction?
A good notary:
- Establishes the identity of the parties
- Checks legal capacity (absence of mental disorders, intoxication)
- Reads the contract aloud and explains the consequences
- Checks spousal consent
- Ensures the transaction is voluntary
The notary does not check the legal cleanliness of the property (sale history, encumbrances, debts) — that is the realtor's and registry's job.

- Parties agree on price
- Preliminary agreement is signed (deposit)
