When a Notary Is Mandatory

2. Minor co-owner involved If a child under 18 is among the sellers - the transaction requires a notary and guardianship authority permission.
3. Transaction via power of attorney If the seller or buyer acts through a representative - the power of attorney must be notarized. In this case, notarizing the agreement itself is also recommended.
4. Sale under an annuity agreement Lifetime maintenance agreements are always notarized.
When a Notary Is Optional But Advisable
A simple written form (without a notary) is acceptable when selling an apartment owned entirely by the seller without minors or shared ownership. But even then, notarization:
- Increases protection against transaction disputes
- Speeds up GRS registration
- Requires the notary to verify parties' legal capacity and document integrity

- Notary checks passports, title documents, GRS extract
