How to Check an Apartment Before Buying in Bishkek: Legal and Technical Inspection
Buying an apartment is one of the largest transactions in life. A mistake here can cost hundreds of thousands of som or even the property itself. Before signing any agreement it is essential to conduct a full inspection in two areas: legal and technical.
Legal Inspection of the Apartment
1. Verifying Ownership Through the SRS
The State Registration Service (SRS) of the Kyrgyz Republic is the primary source of truth about any real estate property. Before purchasing, you must:
- Request an SRS certificate on encumbrances on the apartment (pledge, seizure, restrictions)
- Verify who the owner is — the data must match the seller's passport
- Confirm the absence of seizure — an apartment under seizure cannot be legally sold
- Check for registered residents — extract from the household register
How to obtain an SRS certificate: Go to the SRS Single Window or MFC with the apartment address and your passport. Certificate cost — approximately 300–500 som, turnaround — 1 business day.
2. History of Ownership Transfer
Ask the seller to provide the full chain of documents showing how the apartment passed from hand to hand. Be cautious if:
- The apartment changed hands many times in a short period (sign of a fraudulent scheme)
- The last transaction was completed less than 3 years ago and the seller is rushing (possibly avoiding tax)
- The apartment was transferred by gift or inheritance — verify there are no other heirs
3. Seller's Legal Capacity
A transaction with a legally incapacitated person may be declared invalid in court. Make sure:
- The seller is not registered with a neuropsychiatric clinic
- If the seller is elderly — it is advisable to have their legal capacity notarially confirmed
- If an authorized representative is involved — verify the notarial power of attorney is current
4. Spouse's Consent
If the apartment was acquired during marriage — a notarial consent from the second spouse is required, even if they do not appear in the documents. Without it, the transaction may be contested.
5. Utility Debts
Utility debts do not automatically transfer to the new owner, but they can complicate life. Request certificates of no arrears:
- From the management company or homeowners association
- From "Bishkekteploset" (heating)
- From "Severelectro" or "Bishkekglavenergo" (electricity)
- For gas and water
6. Rights of Minors and Third Parties
If minor children are among the owners or registered residents, guardianship authority permission is required for the sale. Without it, the transaction is illegal.
Technical Inspection of the Apartment
A legally clean apartment may have serious construction problems. It is best to conduct the inspection during the day in natural light.
What You Must Check
Walls and ceilings:
- Cracks — especially diagonal and through-cracks (sign of foundation settlement)
- Water stain traces and mold in corners (leaks, condensation)
- Condition of inter-panel joints in panel buildings
Bathroom and kitchen:
- Moisture under the bath and sink — rotting pipes
- Water pressure — open all taps simultaneously
- Condition of drainage — smell, flow
- Ventilation — hold a piece of paper to the grille, it should be drawn in
Electrical:
- Condition of the switchboard and wiring
- Adequacy of power capacity (modern appliances require minimum 5–7 kW)
- Grounding in bathroom outlets
Windows and doors:
- Quality of double-glazed units — fogging inside means defect
- Correct opening without force — sign of straight walls
Entrance and common areas:
- Condition of stairwells and elevator
- Smells in the entrance (may indicate problems with residents or utilities)
Signs of Unauthorized Redevelopment
Unauthorized redevelopment creates problems at sale and may threaten safety. Pay attention to:
- Load-bearing walls demolished (sign — enlarged spans without additional supports)
- Wet zones (bathroom, kitchen) relocated to non-standard positions
- Configuration changed relative to the BTI floor plan
How to check: compare the actual layout with the apartment's technical passport (Form 7). Discrepancies are grounds for demanding legalization or a price reduction.
Red Flags: When to Walk Away from a Deal
Stop negotiations immediately if:
- The seller refuses to provide documents for inspection
- The apartment price is 20% or more below market without apparent reason
- The seller rushes you to sign without time for inspection
- There are multiple claimants with notarial powers of attorney
- Corrections, erasures, or discrepancies are found in the documents
- The apartment is being sold under a general power of attorney — an extremely risky scheme
