Full Secondary Market Apartment Check in Bishkek Before Buying - Checklist

Buying a secondary market apartment without verification is a lottery. In Bishkek you'll find apartments with debts, disputed heirs, illegal renovations, and registered residents who cannot be evicted. Here's a complete checklist of what to verify before signing.

1. Ownership Rights and History

Request an extract from the GRS (State Registration Service). It contains:

  • Current owner
  • Basis of title (purchase, inheritance, gift, privatization)
  • History of previous transactions
  • Presence of encumbrances and arrests

Red flag: apartment changed owners frequently in the past 3 years.

2. Encumbrances and Arrests

Red flag: court or tax authority arrest - transaction registration is impossible.

3. Registered Residents

Ask the seller to provide a certificate of registered persons (family composition certificate from the CPC). Special attention to:

  • Minor children - eviction requires guardianship authority permission
  • Military personnel and convicts - temporarily deregistered but retain the right to return
  • Persons with disabilities - special eviction procedure

Require: all residents must be deregistered before or at the time of the transaction.

4. Utility Debts

Request debt clearance certificates for:

  • Electricity (Severelectro)
  • Water (Bishkekvodkanal)
  • Gas (if applicable)
  • HOA/management company fees

Important: utility debts legally don't transfer to the new owner, but the HOA may create problems in practice. Better to require clearance certificates.

5. Inheritance History

If the apartment was received as inheritance, check:

  • Has 3 years passed since the testator's death (statute of limitations)
  • Are there other heirs who didn't know about the inheritance
  • Was there a will or intestate succession

Red flag: inheritance less than 3 years ago, many potential heirs.

6. Apartment Technical Condition

During inspection, check:

  • Roof and ceilings (leak traces - brown stains)
  • Corner humidity (mold)
  • Electrical wiring condition (aluminum in old buildings - problematic)
  • Water supply and drainage pipes
  • Windows and balcony condition
  • Ventilation function (hold a lit match near the ventilation opening)

7. Legality of Renovation

If the apartment layout differs from the technical passport - the renovation is unauthorized. This is a problem when:

  • Applying for a mortgage (banks often refuse)
  • Subsequent sale
  • Possible fines

8. Sale via Power of Attorney

If the seller acts via power of attorney - elevated fraud risk. Check:

  • Power of attorney is notarized
  • Power of attorney hasn't been revoked (call the issuing notary)
  • Power of attorney hasn't expired
  • Powers correspond to the transaction being conducted

Ideally: communicate personally with the actual owner (video call at minimum).

9. Spouse Consent

If the apartment was purchased during marriage - notarized spouse consent to sell is required. Even if registered in one name only.

10. Seller's Legal Capacity

A transaction with a legally incompetent person can be voided. If there's any doubt:

  • Conduct the transaction through a notary (they verify legal capacity)
  • Request a certificate from the neuropsychiatric clinic
