Gifting Real Estate in Kyrgyzstan: How It Works and Tax Implications

What Is a Property Gift (Darstvennaya)?

A property gift (darstvennaya) is the official legal way to transfer real estate ownership for free. The donor transfers ownership to the recipient without payment.

The legal basis in Kyrgyzstan: Articles 516–525 of the Civil Code of the Kyrgyz Republic.


Who Can Gift Property?

  • The official registered owner of the property
  • One co-owner (with written consent of other co-owners)
  • A representative acting under a notarized power of attorney

Restrictions:

  • Minors cannot gift or sell property
  • Persons declared legally incapacitated cannot gift property

Step-by-Step Process

Step 1: Prepare Documents

From the donor:

  • Kyrgyz passport
  • Title document (State Act / Technical Passport)
  • If married — notarized written consent of spouse

From the recipient:

  • Kyrgyz passport
  • TIN/INN (if available)

Step 2: Visit a Notary

Both parties meet with the notary together. The notary:

  • Verifies all documents
  • Drafts the gift agreement
  • Both parties sign and the notary certifies it

Notary fees:

  • Close relatives (child, parent, spouse): 2,000–5,000 KGS
  • Others: 1–2% of cadastral value

Step 3: Register at GRS (State Registration Service)

Take the notarized gift agreement to GRS. Registration takes 5–7 business days.

GRS fee: 2,000–5,000 KGS

Step 4: Get New Technical Passport

After registration, the recipient receives an updated technical passport in their name.


Tax Rules

Between Close Relatives

Parent → child, spouse → spouse, sibling → sibling: No tax (gifts between close relatives are exempt under Kyrgyz law)

Distant Relatives and Non-Relatives

10% income tax on the market value of the property.


Common Questions

Can a gift be revoked? Yes. The donor can petition the court to revoke the gift if the recipient acted improperly, or in some health-related circumstances.

What if there are co-owners? Written consent from all co-owners, certified by a notary, is required.
