Why Is It Important to Check a Developer?

In Bishkek, there are periodic situations where residential complex construction freezes and investors are left without apartments or money. Most problems can be avoided by checking the developer in advance.


Step 1: Check the Company's Legal Documents

Ask the developer or enquire at the office for:

  • Certificate of state registration of the legal entity
  • Articles of association of the company
  • Tax ID (INN) of the organisation
  • The authority of the representative with whom you are signing the agreement

You can verify the company's registration through the Ministry of Justice of the KR (minjust.gov.kg).


Step 2: Check the Construction Permit

The developer must have:

  • Construction permit from the Bishkek City Hall (Department of Architecture)
  • Title document for the land plot (lease or ownership)
  • Project documentation that has passed state expert review

The absence of even one of these documents is a red flag.


Step 3: Study the Developer's Track Record

Ask yourself:

  • How many projects have already been delivered?
  • Were there delays on previous projects?
  • Are there any court claims from investors?

Where to look for information:

  • Reviews in local Facebook groups and Bishkek Telegram channels
  • Website of the Supreme Court of the KR — open database of judicial decisions
  • Buyer forums for specific residential complexes

Step 4: Review the Contract Before Signing

A reliable developer agreement must contain:

  • The exact address and specifications of the property
  • A specific handover date (not "approximate")
  • Penalty clauses for late handover
  • Procedure for refund in the event of cancellation
  • Conditions for registering the title

Insist on notarisation of the agreement — this provides additional protection.


Step 5: Verify Financial Stability

Signs of a financially stable developer:

  • ✅ Construction is financed from own funds or bank loans
  • ✅ Banks have accredited the project (it can be purchased with a mortgage)
  • ✅ A significant share of apartments in previous phases has already been sold and occupied

Walk away if:

  • ❌ Construction is not actually progressing despite active sales
  • ❌ The company was registered just a few months ago
  • ❌ The representative cannot present the construction permit

Red Flags: Leave Immediately

  3. File a lawsuit based on the contract
  4. Contact the prosecutor's office if signs of fraud are present
