Who Can Place an Arrest on an Apartment

In Kyrgyzstan, an arrest on real estate can be placed by:

Court - as a protective measure in civil or criminal cases. For example, during divorce and property division, debt collection, or challenging a transaction.

Bailiffs - when enforcing a court judgment on debt collection. If the debtor doesn't pay, bailiffs can arrest their property for subsequent sale.

Tax authorities - for tax debts. The State Tax Service has the right to place an arrest administratively.

Prosecutor's office - in criminal cases (fraud, corruption).

How to Check for an Arrest

  • Online through the GRS portal
  • In person at a GRS office
  • Through a notary when preparing a transaction

Can You Sell an Apartment Under Arrest

No. The GRS will refuse to register the transfer of ownership if an arrest exists. The transaction will be invalid. If the seller concealed information about the arrest, the buyer has the right to cancel the contract and recover damages.

How to Remove an Arrest

The removal method depends on the reason for the arrest:

Arrest by Court Order

  1. Eliminate the reason for the arrest (repay the debt, resolve the dispute)
  2. Apply to the court for cancellation of the protective measure
  3. Obtain the court's ruling on cancellation of the arrest
  4. Submit the court ruling to the GRS to remove the restriction

GRS processing time: 3-5 business days.

Arrest by Bailiffs

  1. Repay the debt under the enforcement order
  2. Obtain the bailiff's resolution on completion of enforcement proceedings
  3. Submit the document to the GRS

Arrest by Tax Authorities

  1. Repay the tax debt
  2. Obtain a certificate of no debt from the tax authority
  3. The tax authority sends notification to the GRS directly (or you submit it personally)

Buying an Apartment Under Arrest: Is It Possible

Theoretically, the parties can agree that the buyer uses their own funds to repay the seller's debt, after which the arrest is removed and the transaction proceeds. This is legal but very risky:

  • New creditors may appear
  • The arrest may be re-imposed before registration
