Selling an Apartment with Children in Kyrgyzstan: Guardianship, Deregistration, and How to Proceed
Selling an apartment where minor children are registered or hold ownership is one of the most complex scenarios in the real estate market. Without knowing the rules, you can delay the transaction for months or receive a refusal of registration.
Two Different Cases: Registration vs. Ownership
It is important to distinguish two scenarios — they are regulated differently:
- The child is registered in the apartment but is not an owner
- The child is an owner (full or partial share)
The second case is significantly more complex and requires permission from the guardianship authority.
Case 1: Child Is Only Registered
If the child is registered (has residency registration) in the apartment but is not an owner:
Is guardianship permission needed? No, if you simultaneously register the child at a different address.
Procedure:
- Find a new place of residence with registration (purchased or rented apartment)
- Simultaneously deregister the child from the old apartment and register them at the new address
- Provide the buyer with a certificate of deregistration
Important: you cannot deregister a child with no new address. The registration authority will refuse if there is no new address. Children under 14 are registered at the registered address of one of their parents.
Case 2: Child Is an Owner
If the child owns the apartment or a share in it (through inheritance, gift, privatization, or maternity capital):
Permission from the guardianship and custodianship authority is mandatory.
Without this document:
- The notary will not certify the transaction
- The SRS will not register the transfer of ownership
How to Obtain Permission from the Guardianship Authority
The guardianship authority is the district or city administration at the child's place of registration (in Bishkek — district akimiats).
Documents to submit:
- Application from both parents (or the sole parent/guardian)
- Parents' passports
- Child's birth certificate
- Title documents for the apartment being sold
- Documents for the replacement apartment being purchased (or certificate of alternative housing)
Main condition for obtaining permission: Guardianship authorities issue permission only if the child's housing conditions do not worsen. This means:
- The child's share in the new apartment is no smaller than in the one being sold
- The new housing is not inferior in parameters (no smaller area, no worse district)
- The proceeds from the sale of the child's share are directed toward purchasing new housing
Processing time: 15–30 days.
What Happens If You Sell Without Guardianship Permission
The transaction may be declared invalid in court — on application from the guardianship authority or from the child themselves after reaching age 18. This is a serious risk for the buyer.
Selling an Apartment Purchased Using Maternity Capital
If the apartment was purchased using "Bala Shayması" funds (maternity capital) — under the program conditions children must be allocated shares. Selling such an apartment always requires guardianship authority permission.
The Buyer Is Also at Risk
If you are buying an apartment and children are registered in it — require:
- A certificate of registered persons with a current date
- Confirmation that the children have been or will be deregistered before the transaction
- If children are owners: guardianship permission
A buyer who has not verified this risks receiving an apartment with a registered child who cannot be deregistered without a court order.
