Dividing an Apartment in Divorce in Bishkek: Rights, Procedure, Nuances 2026
Divorce is one of the most stressful life situations, and dividing an apartment often becomes the main stumbling block. Let's look at how this works under Kyrgyzstan's law and what you need to know to protect your rights.
What Property Is Divided and What Is Not
Jointly acquired (divided equally):
- Apartment or house purchased during the marriage — even if registered only in one spouse's name
- Mortgage apartment taken out during the marriage
- Commercial real estate acquired during the marriage
Personal property (not divided):
- Apartment received through inheritance — even during the marriage
- Apartment received as a gift under a gift agreement
- Property purchased before the marriage
- Apartment purchased with the personal funds of one spouse (important to prove the source)
Important: if an inherited apartment was re-registered or renovated using joint funds, the other spouse may seek compensation for the investment.
How an Apartment Is Divided: Three Options
1. Voluntary Agreement
The quickest and least expensive path. The spouses reach an agreement between themselves and formalize it with a notary in the form of a property division agreement.
Options:
- One pays the other compensation and remains the owner
- Sell the apartment and split the money
- Register as shared ownership
2. Prenuptial Agreement
If one was concluded before or during the marriage, division takes place according to its terms. In Kyrgyzstan, a prenuptial agreement is still rare but is fully legally valid.
3. Through Court
If an agreement cannot be reached, property division is decided in court. The court generally divides the apartment equally, but may deviate from this principle in favor of the spouse with whom minor children remain.
Dividing a Mortgage Apartment
This is a particularly complex case. The mortgage is a joint debt, and the bank is a third party here.
Possible paths:
- One spouse takes the apartment and mortgage — requires the bank's consent to re-register the loan
- Sell the apartment, pay off the mortgage, split the remainder
- Continue paying jointly — works only when relations are amicable
None of these options can be implemented without the bank's involvement. Most Bishkek banks agree to re-registration but verify the remaining borrower's creditworthiness.
If Children Are Registered in the Apartment
Children have no right to their parents' real estate, but the court takes their interests into account. If children remain with one parent, the court often leaves the apartment with that parent, subject to compensating the other.
A minor cannot be deregistered without providing alternative housing — this restriction remains in effect even after divorce.
Apartment Purchased with Parents' Money
A common situation in Bishkek: one spouse's parents contributed money for a purchase. If this money was structured as a gift — the apartment is considered personal property. If it was simply handed over in cash without documents — proving this in court is extremely difficult.
Tip: if parents are helping with housing, formalize it with a notarial gift agreement.
Step-by-Step Procedure for Division Through Court
- File a claim in the district court at the property's location
- Have the apartment appraised (to determine compensation)
- Await the court ruling
- Register the change in ownership with the SRS
Timeline: 2 to 6 months depending on case complexity and court workload. State duty: 1% of the disputed property's value.
Statute of Limitations
A claim for property division may be filed within 3 years of the divorce. This does not mean you should delay — the longer you wait, the harder it is to prove facts and gather documents.
What to Do Right Now
If you are going through a divorce and the apartment issue is unresolved:
- Order an extract from the SRS — confirm the apartment has not been re-registered without your knowledge
- Do not agree to verbal arrangements — only documents
- Do not delay drafting the agreement or filing the claim
