Tax on Selling an Apartment Owned for Less Than 3 Years in Kyrgyzstan 2026

Many apartment sellers in Bishkek are unaware of the tax implications — until they receive a notice from the tax authority. Here we explain when tax on a sale is due and how to minimise it legally.

The Basic Rule

In Kyrgyzstan, an individual is required to pay income tax on proceeds from selling real estate if:

  1. The ownership period was less than 3 years
  2. The sale price exceeds the purchase price (there is taxable income)

If the property has been owned for more than 3 years, no tax is payable.

Tax Rate

10% of the income amount (the difference between the sale price and the purchase price).

Example calculation:

  • Purchased an apartment in 2024 for $40,000
  • Selling in 2026 for $52,000
  • Income: $52,000 − $40,000 = $12,000
  • Tax: $12,000 × 10% = $1,200

When Tax Is Not Payable

  1. Ownership period exceeds 3 years — full exemption
  2. Sale at or below the purchase price — no income, no tax
  3. First sale in the year for citizens selling their only home (confirm the current status with the tax authority)
  4. Inheritance — if the apartment was received by inheritance, the period runs from the date of the testator's death

How to Calculate the Ownership Period

The period is counted from the date of state registration of ownership with the GRS, not from the date of the sale and purchase agreement. The date can be verified from your state certificate or technical passport.

How to Declare and Pay the Tax

  1. By 1 April of the following year, submit an income declaration to the tax authority at your place of residence
  2. Attach documents: the sale and purchase agreement for the current transaction and the document confirming the previous purchase
  3. Pay the tax by 1 April

The notary is required to send information about the transaction to the tax authority — failing to declare is a risk.

How to Legally Reduce the Tax

Method 1. Wait 3 years

If there is no urgent need to sell, it is more cost-effective to wait until the 3-year period has elapsed.

Method 2. Document renovation costs

Money spent on renovation can be treated as expenses, reducing the taxable base:

  • Receipts for building materials
  • Contracts with renovation contractors
  • Estimates of completed work

Method 3. Account for purchase costs

Realtor commission, notary fees, property valuation — all of these reduce the net income.

Is tax due if the apartment was gifted rather than purchased? Yes, the ownership period runs from the date the gift was registered. If sold before 3 years, tax applies to the difference from the market value.

What if the purchase agreement stated a reduced price? The tax authority may use the cadastral or assessed value. Understating the contract price carries the risk of additional assessments and penalties.
